Abandonment and Child Support
so here is a tough situation cant find nothing on it. I am being served with child support papers and i live in idaho she lives in california. about 5 years ago i was served with abandonment papers to go to court. i went back to california went to court for my rights to be destroyed. i was never informed about the childs pregnacy nor the childs delivary date. I went to court and had a parturnaty test done and i payed for it as well my rights were taken away and my name never was on the birth certifacate how is that she can come after me for child support and what are my rights if i start paying child support
Re: Abandonment and Child Support
What exactly does the paper say that takes away your rights? (word for word leaving out all identifying information such as names, etc.) Is that paper signed by a judge?

well my rights were taken away and i had no legal right to him and that. i was not to have any contact to him or her and yes we did go to court and it was signed but im getting papers from the child support service in california
Re: Abandonment and Child Support
The court doesn't generally just terminate the rights of a parent just because the other wants it done and they for sure don't do it when the parent didn't have any rights in the first place...
So, let's start from the beginning. What were you served with and what was the ultimate disposition of that case?
As for what your rights are if you start paying child support. You have the right to pay support. Paying child support doesn't give you any inherent rights, except for the right to know that you are legally someone's father.

Child Support services doesn't award or take away "rights." So find the papers, read them and tell us what they say.

ok it was for adoption so i thought i went to california come to find out the mother was taking me to court for Abandonment. she won the case in court by the judge. I ws never put on any birth certificate and never was informed of the child til that court date. while in court i had a dna test done i payed for out of my own pocket not knowing if the shild was mine or not i had to request to have one done the courts never asked me or ordered me to take one i had to ask them for a parturnaty test. so five years later i am getting served by the child suppport services to pay child support which my name was never put on any birth certificate or anything all i have is this paper my question can they do this and deduct my wages

Re: Abandonment and Child Support
STOP TALKING ABOUT BIRTH CERTIFICATES. BIRTH CERTIFICATES MEAN NOTHING EXCEPT FOR A CHILD WAS BORN.
Now... do you want to go tell us what the papers say EXACTLY or do you want me to tell you to go pay an attorney to figure it all out? Those are your options. Those are your ONLY 2 options.

I suspect that he doesn't have the court paperwork at all...and I suspect that he needs an attorney. It somewhat sounds like a situation where his parental rights were terminated so that a stepparent adoption could happen. If that was the case, then either the stepparent adoption never happened or someone is being less than honest with the CSE.

Or the money that is being collected on is money that came before the adoption (if there was an adoption). The fact of the matter is the OP doesn't know what he's talking about and you can spend all day speculating as to what could have happened, but if he can't give anyone a piece of information then throwing around theories is just irresponsible.
Adoption petitions have a very specific look in CA. There are a TON of things that happen before an adoption takes place. It's not a one and done process and a paternity test wouldn't have been done and if it were done, it wouldn't have been done at the OP's expense. That's not the way it works.
