Former Supervisor Making False Statements
My question involves labor and employment law for the state of: dc
I resigned my position 6 weeks ago, now my former employer is accusing me of sexual harassment that allegedly happened when I was there.
Btw i am a girl.
My former employer is telling other coworkers that I allegedly sexually harassed my supervisor who is a man 20 years my senior.
I think they are crazy my question would be can they do anything against me?
Re: Former Supervisor Making False Statements
Their use of "allegedly" is clever on their part. If the man did report something, then your ex employer is allowed to tell the truth.
Professional? Not particularly
Illegal? I would say "not"
Re: Former Supervisor Making False Statements
I understand that. They can say whatever they want, my question is can they legally take me to court for the alleged harassment?
This person allegedly made a complaint about me 6 weeks after I left. They are saying they fired me, which i can proof is a lie. As for the harassment, if he feel harassed he never complained about it with me or anyone. Not while i was there. So can he sue me in civil court?
Re: Former Supervisor Making False Statements
The employer can't sue, no.
But the alleged victim can try to sue.
Whether or not he'd win, we can't guess. If he can't articulate damages, that won't help him.
Re: Former Supervisor Making False Statements
Well if he sues me, he sues me. I have nothing. No income or a job or nothing.
Thanks a bunch!
Re: Former Supervisor Making False Statements
Honestly I can't see him be successful.
Re: Former Supervisor Making False Statements
Thanks! This person never even told me he was feeling harassed and we shared an office for 18 months. If he was, maybe the complaint should have come when i was there.
Re: Former Supervisor Making False Statements
Folks, I don't think that sexual harassment works that way.
Isn't the whole premise of sexual harassment is that the harasser has to have some power over the harassed? Therefore, how can a boss be sexually harassed by an underling?

Also, the only obligation the employer has is to stop the harassment. The alleged harassment stopped december 10th, which was the last day I talked to this man. The complaint was made over 2 months later.
If I was I harrasing him and showing to work dunk, according to them for almost the duration of my assignment there, how come no complaint was ever made until more than one month after i left. By then, the alleged harassment would have stopped.
Re: Former Supervisor Making False Statements
No, not at all.
Sexual harassment (or any harassment really) does not require the victim to be an underling.
