Can I Get Emancipated Due to Religious Differences With My Parent
My question involves juvenile law in the State of: Florida
I know that you have to be 16, so I'm not talking about getting emancipated right now since I'm only 15. I turn 16 in October. My situation is basically I got kicked out of my mom's house because I told her I didn't want to be her religion (Jehovah's Witness). So my Dad came from Colombia so I can stay with him. But he hasn't found a stable job yet and he plans on only being here for about a year (So once he leaves I will already be 16). I have applied everywhere that hires at 15 but I haven't gotten hired. Although there are many places in my area that hire at 16, so if I were to get a good and stable job once I turn 16 and save up for a couple months before my Dad leaves, what are the chances of me being emancipated? I know your guardian has to approve and my Dad already did since he knows I'm responsible and do very well in school and such. He even said he'd help me out with my rent and bills till I'm 18. I'm not a naive teenager that just doesn't like my parents rules, I don't actually want to get emancipated but once my dad leaves I won't have anywhere to go. I know I have to get a job and pay my own rent and electricity and bills and buy my own food. I am okay with this. Just please give me some information on it so I can start planning my emancipation throughout this year and save up so by the time I'm 16 I have a jump start.
Thank you, any help is appreciated.

    Re: Emancipation
    Sorry, not going to happen.

In Florida, your parents have to file the petition to begin with - you cannot.

The court will look for just about any reason to deny the permission, and if Dad is helping you out financially that's all the court needs to say "no".

Now if BOTH parents allow you to live outside of the home, that's different. But emancipation isn't going to happen.

What if my mom were to allow it as well? She does not want me living with her either.

My dad will file the petition and my mom will also agree to it. And if my dad helping me out financially is a problem then that is not something I would do.

Parental permission is just the first step.

Even if your parents agree, you'll still need to prove to the court that you're capable of supporting yourself fully. This is tricky, because you're going to need enough money to keep you afloat, but you also have to make sure your grades are better-than-decent too. That's something of a catch 22.

The courts will generally look for any reason to deny a petition.

Are there no relatives you could live with? Allowing an Aunt or an Uncle would be much better, and your parents can do that.

Tell your mom you love her and understand she is going to Hell, but your plan is going to Heaven so you do not want religion to be a barrier in her home between the both of you. With a bit of tolerance, it can work.
