Daughters Ex Asked Her to Terminate Rights
My question involves a child custody case from the State of: Arkansas. My daughters ex boyfriend has told my daughter if she signs away her Parental Rights she will be able to seeher 2 year old. She just turned 21 and is trying to get on her feet, and he has had their son for over a year because she didnt have permanent housing or a job. She said this way she will be able to see him when she wants.. I need some information she can see besides from my mouth that she is about to make a mistake she doesnt relize how bad. He has a lawyer and she doesnt. He knows this and also knows she dont share information with her family about her private affairs. I just fiund out today and she is supposed to sign papers tomorrow... p, ease help me give her information on what she is abojt to do.. thank u

She can't sign her parental rights away. What exactly is she signing?
She can sign her custodial rights away, but she really needs to NOT DO THAT.
I can just about guarantee that Dad will not honor that promise.

Arkansas law provides for the termination of parental rights only for (a) adoption, or (b) a DHS dependency or neglect determination. If something else is going on, you will need to provide additional facts.
If your daughter wants to see her son, and for some inexplicable reason has chosen not to pursue visitation through a court, she should seek visitation through a court.
If she consents to stepparent adoption, post-adoption she will have no right to see the child. If she consents to a custody order that gives her no custody or visitation rights, she will also have no right to see the child.
She should not sign anything without having it reviewed by her own lawyer.
