Sexual assault probation violation
A person that is in my family is being accused with a probation violation. This is based on a lie detector test. He has admitted to a couple violations but they are keeping him in jail saying that they need more information. While this is happening his family cannot see him or even send him any messages. It has been 48 hours that they have kept him in jail. There are no lawyers involved at this point. Can anyone tell me if what they are doing is legal (keeping a person in jail until he says what they want him to say)? Should lawyers be involved in this? How long can they keep him for in jail? A person on probation does not normally have the same rights as someone who has not yet been found guilty of a crime. But by the same token there are limits and it is doubtful they can be held incommunicado. As is the case with most legal matters, especially if they are of a serious nature and the situation certainly sounds that way, the earlier counsel is acquired the better if for no reason other than helping the client understand the process and procedure.
