    Expunging a State Conviction Under Federal Law
    Please Help!

    My question involves criminal records for the state of: Maryland

    Hi, 18 years ago I was charged with marijuana possession in Maryland under state statute. My record was expunged, and I believe that my lawyer used 21 U.S.C. 844 or 18 U.S.C. 3607 to do so. I understand that my charge was not a federal one, but I believe my lawyer found a way to use the federal provision for expungement purposes.. This code has significant advantages over expungement under the Maryland code; including not having to report the charge out (legally and as provided on the SF86) on security clearance forms.

    My question is this: is there a way that my lawyer could applied these federal provisions for expungement to a state charge? I guess I'm not exactly sure how he would do that...maybe some case law or special code provision. I'm not able to verify it because the court can't tell me anything, and he has unfortunately passed away.
