Can You Get Emancipated from a Guardianship
Hello, I am going to be 17 in March. My mom is deceased and i dont live with my dad. Ive been thinking about emancipation since i moved in with my guardian. When I came to VA, my grandmother got joint custody of me ( the other w/ my dad). After a while i decided to live with my aunt and my grandmother agreed, but she till has custody of me. Meantime i am trying to get into college, do drivers ed, get heath insurance, etc. And my grandmother is making it hard for me to do any of those things. I am in teachers aid at a daycare and i cant start to work legally until i have certain shots, and i cant do that until my grandmother gets me med insurance. I cant do anything without her signature or anything like that. She is procrastinate and i want to be emanicipated. My dad agrees too. Would it be hard for me as a 17 year old in VA? Is that a legitimate reason?

Re: When Can a Minor Get Married or Emancipated
As a 17 year old, you are not likely to have the resources to sustain emancipation. Even if you did, you would likely be 18 by then. If you cannot afford insurance now, how would you expect to obtain it if emancipated? Go and get it if you can. To be emanciapted in VA you must be ..."capable of supporting himself and competently managing his own financial affairs". You cannot even afford health insurance.

    Agree with Disagreeable.

Suck it up till you're 18. It won't be that long.

No reason is good enough if you cannot support yourself 100%. The court is going to look at whether or not you have the capability of paying rent (market rate, not a token for living in someone else's house), utilities, food, clothing, insurance, transportation, medical care, staples, school fees and supplies, and all the other incidentals of life. If you can't do that, you'll be denied before they ever get around to assessing your reasons.
