Ticketed for Jaywalking While Driving a Car
My question involves a traffic ticket from the state of: California
Hi,
I got a traffic ticket that I need to know how dispute, I know its wrong because when they looked it up down at the court house its under Jay Walking I was driving a car, the officer was very confused on the day he gave it to me. I was not speeding I was not breaking any driving laws my tags are in order. So when I tried to engage him and ask why he pulled me over, his only response was look it up. the number he wrote down comes up as Jay walking very odd. please help me dispute this, I can't afford 200 dollars for unfair traffic - this took place in December 2013.
Thank you for your help
there may be a number that is hard to read 21755 or 71755 I'm not sure which is right hard to read writting
Re: Ticketed for Jaywalking While Driving a Car
You should keep the citation number to yourself. What you need to share with us is the statute number identified on the ticket, or jurisdiction and ordinance number.
The ticket says you are charged with what offense, citing what statute or ordinance?
Re: Ticketed for Jaywalking While Driving a Car
VC 21755 is a failure to pass safely on the right, not a jaywalking violation.

I was coming out of a driveway and we were all stopped at a red light I was allowed in by a vehicle on the right side exit, I got followed by the police car and pulled over.

Name the intersection and tell us which direction you were headed.... And describe which driveway you came out of...
Re: Ticketed for Jaywalking While Driving a Car
they told me the jay walking description at the court house when I talked to them over the phone. glad to have it cleared up its still an unfair ticket did not pass unsafely.

Lankershim and Vanowen intersection and I was headed south on Lankershim , I was coming out of a mini mall driveway.
we were all stopped so no one was moving at the red light I did go in between two cars to go on Lankershim.

And you did that with a cop on your tail... So, there you go... All of a sudden, it became a fair ticket!
Re: Ticketed for Jaywalking While Driving a Car
a friend in the area told me he saw the incident from the street said the motorcycle police come out of a hiding spot they like to ticket people at that corner.

OK, so he wasn't on your tail but at a good vantage point where he saw what you did. My apologies! Unfortunately, there is no prohibition on them hiding before they issue a ticket... As long as he saw you commit the alleged offense, it doesn't matter where he saw it from.
While I'm still unsure what you meant with "I did go in between two cars to go on Lankershim", and in spite of you saying he was "confused", the way I look at it is if it was not illegal, the cop would not have cited for it.

It would be interesting to know if when a car stops and waves you on and signals you to pull in front of them if it is forbidden to do so? If so, is it expected for both of you to just sit there, stare at each other, and impeded traffic? If a policeman was 'hiding' at a distant vantage point, and did not see the motorist wave you on, he may be incorrect at interpreting that as cutting someone off. Especially if he will not listen to anything you had to say.
Getting permission from another motorist to proceed would make it a safe, legal and cooperative move IMO.
