Relocation Without a Parenting Plan in Place
My question involves a child custody case from the State of: WA
I have two children who live with me full time - they visit their father every other weekend. I am considering moving to another county in my state, within 60 miles of our current location. We currently do not have a parenting plan in place and I would like to file one soon. Is it better to wait until I move and file in the county I am moving to or file prior to the move? The children's father does not have a drivers license, hAs had multiple DUI convictions, and does not have his own residence (he stays with his mother when the girls visit him. Any advice is greatly appreciated! Thank you!

How far does the children's father live from you now, and how much distance from HIM, will your move create? Are you willing and able to provide all of the transportation to maintain his every other weekend visitation?

He currently lives approx 10 miles from our home now; we would be moving about 50-60 miles from him. I would be willing to transport the children to and from to accommodate the visitations every other weekend.
My biggest concern is that if I establish the parenting plan in the county we are currently in and then try to move after the case has been opened, he will try to prevent the move from happening. There have been issues of violence from him in the past, and I am fairly worried that it would create a problem if he found out we would be moving prior to the move. There is not a restraining order currently in place.

He can challenge the move either before or after you move. Since there is no parenting plan in place you are free to move, but that doesn't mean that he cannot challenge it if he chooses to do so.

The presumption in WA is in favor of relocation.
If Dad challenges, he's going to need a darned good reason for doing so. The burden of proof is on him, not you, Mom.
Even more importantly, you're offering transport to basically keep the same schedule; Dad is going to need something huge in order for the court to rule in his favor.
