How Long Does Extradition Take
My question involves criminal law for the state of: utah
My husband was stopped for a headlight out in the next state over. There was a felony warrant out on him for some missing paperwork. That is all cleared up, but he needs to get back home by a Marshall. How long can they keep him? It is only 2 hours away, and they won't let me pick him up.

apparently something is not cleared up if they will not release him. Either they hold him to extradite him to the state with the warrant or they release him as the warrant was recalled or considered served. It appears they are holding him for extradition. That would make sense that he must be delivered by a Marshall. I suspect the Marshall (ffrom the state with the warrant I presume) is not simply bringing him back home but taking him into custody so your husband can appear in court as the warrant demands.
and what kind of "missing paperwork" equates to a felony?

If he is fighting extradition then I believe it is 30 days that the other state has in which to obtain a Governors Warrant and have him brought back to face the pending charges.
