Can You Appeal a Guardian ad Litem Opinion
My question involves a child custody case from the State of: Rhode Isalnd
I am in the process of a divorce (she has been having an affair for about two years). I tried to repair my family (based on my values). She filed. I was a Mr. mom and secondary earner for a bunch of years to be available for our kids schedules.
I had to pay for a Guardian Ad Litum. I, and my attorney, were completely shocked by her decision. She was granted placement, and I am being forced to leave our home in 30 days. Two of my children have said to me since that they want to live with me, not her. My conversations with them were very positive and trying to help them through the change. They volunteered this information. The youngest has been subjected to months of comments about happy rewards in the future (we'll get a puppy, you can have a bigger bedroom, etc). I've documented these and firmly believe they influenced her discussion with the GAL. My son was too emotional and shy to say a lot. And my oldest said she basically asked to be placed with me.
My spouse has gone through a mid-life crisis since turning 40...what led to the affair and she actually believes the lies she states, I think. She also has a gifted manipulating bully of a lawyer.
I am desparately looking for any way to combat this mistake. Can I appeal to the GAL? the judge? Can anyone provide guidance on this?

If you do not like the courts ruling, appeal it. GAL opinions get significant weight.

A guardian ad litem makes a recommendation, which the court can either accept or reject. You and your lawyer can argue to the court that the GAL's recommendation should not be adopted. If you don't like the judge's decision, you can appeal from that decision.
