Can My Landlord Install Speed Bumps
My question involves landlord-tenant law in the State of: California

The management of my apartment complex added 10 tall speed bumps to get to where I park. They are tall and I would like them lowered to a more reasonable height. It is miserable to drive in and out. Do I have any power or justification to fight this change?

I know this seems petty but I am so emotionally frustrated that it is effecting my life and work. I have never had a problem with the complex before, I simply see this change as drastic, poorly thought out and damaging my car.

    Thanks for your input.

You need to try to find out if the speed bumps are higher than regulation...because you are right, speed bumps that are higher than regulation can and do damage cars. If they are not higher than regulation, you won't be able to do anything about them.

If it's getting to you that much then you need some mental health counseling.

It won't damage your car if you.........drive...........very...........slowly. .......... over the speed bumps just like the rest of us do every time we come across one.

Thanks for the input, I will check to see if they are outside of regulation. My guess is they are touching an upper limit but probably not breaking any.

I appreciate the response, although I would prefer one a little less......... pretentious.

Build a monster truck with 38" or larger mudders. You can go over them without missing a beat.

I have a full size 4WD truck, my wife drives an audi sports car. I have to remember that not only can't I not hit the speed bumps at speed in that car, I have to watch uneven road services between the lanes (the tires are vary low profile and we've scraped the rims on uneven pavement).

Still it is YOUR RESPONSIBILITY to observe obstances and not wreck your car on them. They have no responsibility to you for damages YOU inflict. Now if the bumps are making it impossible to get to your rented space at no matter how slow you cross them, then you might have a claim on the use of the apartment.

Making you have to cross them at an incredibly slow speed, is WHAT THEY ARE THERE FOR. You have no claim to have them reduce them so you can speed through the lots.

Thanks for your reply. I guess it is worth clarifying as it seems every thinks I want to speed over them. I have to come to a full stop before each speed bump then inch over them. Even when I do this it still is a rough transition over the bump. I don't feel a full stop is the point of a speed bump.

I was hoping there would be some law or rule in place that says if a landlord lowers the quality of the apartment you live in then they are required to adjust rent accordingly. I know speed bumps are an odd example but imagine if they came in a replaced the refrigerator with a lower quality one or something like that.

The quality - or in this case, convenience - of the parking lot has nothing to do with the quality of your apartment. You don't live in the parking lot.

If you actually have to do that, then its very likely that they are higher than regulation height.

Speed bumps are considered to enhance the safety of pedestrians...so that one probably won't fly.
