    Child Has Deceased Man's Name Not Mine
    My question involves name change laws in the State of: Ohio. When my daughter was born, the mother gave her her last name which is the last name of the man that she was married to and he is deceased. For example her maiden name is "Smith" but her married name is "Jones". My daughter's last name is "Jones". The mother and I were not married and paternity was established. I would like to have my name on her birth certificate and her name changed to my last name. This woman and I have 2 daughters together and the oldest carries my last name. Would the mother have to agree?

    If the child is 18 or above, she can make her own petition for a name change and the consent of the parents (or putative parents0 are not required.

    If the child is under 18 (and above let's say a year old) and you have established paternity you can make a petition to the court. Either the mother must consent or she has to be notified of the hearing so she can express her concerns. The judge will determine if the name change is in the best interest of the child.
