    How Can a Runaway Get Emancipated
    I am in California and I ran away from home a few months ago, because of physical, emotional and sexual abuse. I am currently living with one of my friends and no my parents are not aware of this. She says that I may stay with her for as long as I need. I would like to become emancipated, I will be 18 in 5 months. Living with my parents until then is NOT an option. Their abuse has been reported to CPS, and I am in the custody of a shelter for endangered youth. I am in Sacramento county. I am enrolled in school although I haven't attended since running away, I would like to be emancipated so I can graduate on time and get a job so I can support myself. What are the chances of it being granted? I have no lived with my parents in 4 months.

    None. You are not supporting yourself and managing your own financial affairs; you do not qualify to be emancipated.

    A judge will not emancipate you so that you can get a job and support yourself; he emancipates you because you already have a job and are supporting yourself.

    Besides, you couldn't even get on a court docket in five months. You'll be emancipated by virtue of age before you could get the case heard.

    Further a court will not reward you for dropping out of school.

    since it appears the courts are already involved, the courts will determine any visitation periods; not you or the parents.


    Sounds like you need to just ride it out until you are 18 and then go on your merry way.

    I did not drop out of school. The emergency shelter I was in was going to send me back to my parents after I told them I was not safe there. So, I had to do something. I can't go to school right now. Well how is someone in my situation suppose to have a life without abuse if my parents would no longer let me have a job, (I have had 4 in the past and paid for ALL my own things) being at the shelter, a job is not an option. So I have no chance of ever having a job no matter where I go unless I am emancipated. Everyone always makes out run aways to be some sort delinquent because of "dropping out" of school. I will do anything o get away from the abuse I was taking.

    Also I may not have a job, but I do work and have my own money legally.

    Emancipation is not a right. If you are not making enough to pay every single cent of your own support, you will not be emancipated. Period.

    In NO case has there EVER been a minor emancipated SO THAT he can get a job. Not supporting yourself? Not emancipated. End of discussion.

    I obviously just said that I make my own money. If that's not supporting myself then no one on this earth "supports" themselves. Ridiculous.

    "Making your own money" is NOT the same as supporting yourself. Supporting yourself requires paying for 100% of everything - that means market rate rent, utilities, food, clothing, transportation, health care, incidentals.

    In what fashion are you "working legally", if you don't have a job? Do you make enough to support yourself 100%, as outlined above? If so, you would have to be living on your own, paying for everything 100%, for anywhere from 6 months to a year to demonstrate suitability for the barest possibility of emancipation. Since you're going to be 18 in 5 months anyway, you wouldn't even have time to bring forth the petition.

    You're not a candidate for emancipation, no matter how much you stomp your feet.

    So, you're paying the market rate of rent for where you live? You pay for the utilities - electric, gas and phone? You're buying every bite of food you put in your mouth? All your own clothing? You paid for your health insurance? You pay for your own transportation? You're paying your school fees and supplies? You buy all the staples?

    No?

    Then you're not supporting yourself.

    Did you know Market Rate Rent means this? Most apartment complexes require you to earn a minimum of 3 times the rent.
