Eviction Forms Received from Parents Without Any Prior Notice
My question involves an eviction in the state of: California
Today I received forms UD-100 "COMPLAINT--UNLAWFUL DETAINER", CM-010 "CIVIL CASE COVER SHEET", SUM-130 "SUMMONS--UNLAWFUL DETAINER--EVICTION" forms. I've been verbally threatened to be kicked out for a few years now, but have never received any kind of written notice to leave. A few days before I was verbally told that "[I] have 60 days." None of the 3 documents I've been given say anything about how long I have to stay. The unlawful detainer complaint form doesn't make any statements besides filling in the names and specifying me as a "son living in residence", so I don't understand how I'm supposed to respond to the denial/admission portion of the form UD-105 "ANSWER--UNLAWFUL DETAINER" . The room I've been staying in has been stripped of a door and has a large stain on the ceiling from a leaky roof. Is there anything about these circumstances that would buy me more time to get things figured out?
Thanks very much.
Re: Eviction Forms Received from Parents Without Any Prior Notice
Probably not.
Frankly, if you were living with your parents and over the age of 18 you might not even have been a tenant and, therefore, not subject to the notice requirement.
That your parents gave you 60 days to leave and immediately filed in court tells me that there is a lot more going on than you are revealing.
That you can't "figure out" what to do between now and the time you get to court doesn't say anything good about you.
Bottom line, if your parents don't want you there they will get you out soon enough. If you ride the deadline for court, the sheriff will be happy to put you out.
Re: Eviction Forms Received from Parents Without Any Prior Notice
My confusion arises from the fact that I did not receive any kind of paper saying I have 60 days to evict.
Re: Eviction Forms Received from Parents Without Any Prior Notice
Read the paper close. It likely says you have 30 days. You were verbally told 60. The paper will override anything verbal.
Advice:

(2) Go to WalMart or any other store first thing in the morning. Water boxes, Banana Boxes, and even Toy Boxes are the best. And their free! Invest in a box cutter, tape and tape gun. If you don't have a vehicle, but one of those little-old-lady mini-shopping carts for $20. Cut down your boxes, load 'em into the cart....
You know what? My ex-roommate kicked me out. I was packed, U-Haul loaded, and gone in 4 days. Why stay in a hostile environment? I had friends to help with the U-Haul loading and unloading.
Know that if your parents have to force the issue with the police - they may not let you take anything but the clothes on your back and anything you have proof that you purchased with your own funds.
