Faking a Child's Death to Get People to Give You Money
My question involves criminal law for the state of: NC
My fiance's ex created a website claiming their daughter died of a rare neurodegenerative disease and is asking for people to donate money to her. The ex's parents, siblings, and friends are also on the site claiming the child died. However the child is very much alive, so the website is an obvious lie. My fiance and I had the site traced to the ex and she is the owner. Is there any legal action that could be taken against her, or would it not matter in court?
Re: Faking a Child's Death
Any legal action would not be your fiance's place to demand.
Re: Faking a Child's Death
Make a report to the police. If their investigation results in the conclusion that there's probable cause that a crime occurred, they will pass the matter along to a prosecutor for review.

report it to the police but more importantly, if any money has been donated to her through the site, report it to the IRS. If her claims were legitimate, then the donations are a gift. If a fraud, she owes taxes on it because it is income derived from fraudulent activities and she owes taxes on it.

Re: Faking a Child's Death to Get People to Give You Money
The IRS only cares if there is a claim of tax deductibility (or she doesn't declare this income). They don't enforce any requirements on charities that aren't taking advantage of tax benefits for charities.
The police or perhaps the state attorney general is the place to go. It is illegal in NC to raise money by false pretense.

I wonder how long it will take for Mom to take down the website.
Or use of any number of almost-reasonable excuses in order to make the whole thing go away.

In her prior thread the website was allegedly created in 2009. I suspect that it was long gone, long before now.

I'm sure if they're that concerned they took screen shots.
