Can I Be Arrested if Someone Saw Me Stealing, Got My Plates, and Notified the Staff
My question involves criminal law for the state of: California
If I took clothing off a rack that a store had outside on the sidewalk in front of the store and walked to my car and drove away, but I think a random pedestrian noticed me, possibly took down my licence plate, and then went into the store to alert the staff, is it likely I will be found and arrested ? I feel awful and I want to go take it back but I m afraid of the possibility that maybe I m just paranoid and they didn t noticed me stealing/get my licence plate/call the police/etc, but if I go back there to return it now they will call the police if they hadn t already. I live in California, I have no record, and it was all off the three dollar and under rack. What could happened and what should I do ??

Why do you call yourself Innocentgirl? No one can advise you to keep the items you stole. In fact if they have video in the lot your doorbell may be ringing soon.

Yes, it is possible you could be identified and charged with theft. It is possible you will be arrested, your car might be impounded and you could do jail time and a long stint on probation where you will have the police come and go from your home and vehicles any time they please.
The time to consider the consequences is before you commit the crime. Clearly you did not feel bad about stealing until after you might have been caught. And, statistically speaking, this is not your first time committing theft. But, HOPEFULLY, it will be your last.

And if they don't have video in the lot? Which I don't think they do, nor do I think they have any out front of the store which is where I took the items from. I never set foot in the actually store.

A witness works just fine. They do not need video, and theft can occur almost anywhere.

If there is no video and no member of the staff saw it all it was was a random lady saying she saw me put unbagged clothes in my car, what are the chances they will actually try and peruse me ?

If she SAW you, and the staff confirms items have been stolen, I'd say it's pretty good.
Don't steal and you won't have this dilemma.
