Can You Collect Child Support from a Trust Fund
My question involves child support in the State of: Wyoming - Married in California, divorced in Wyoming, ex husband then moved back to California. Myself and our son stayed in Wyoming, where the courts then retrieved child support though his wages in California. Child support was paid though the courts, but not kept track of. About year after divorce, ex quit job and never had anymore wages (that we could find). My ex husband's father (the last surviving parent) has just passed away (in California). My question is, can I collect back child support from my ex's part of his fathers living trust? If so, how do I go about filing? If not entitled to his part, then how do I go about collecting back support? Thanks for any help.

You'll have to once again chase down Dad in order to get "his" part of the trust. You have no claim against the trust yourself.

If the trust still holds assets that are to be distributed to the beneficiary, and there is nothing about the trust that would impair collection of those funds (e.g., if it's a spendthrift trust), you can petition the court for an order to try to attach the trust's assets. You can see if child support services can assist; for most people, it's probably not a do-it-yourself project. The more information you have on the trust and its assets, the better.

Well, now I feel like a prize prune.

For some reason I actually ignored the question and instead decided to answer something not only not asked in the first place, but based on another premise entirely.

    Mea culpa.
