Accused of Defrauding Someone on eBay
My question involves criminal law for the state of: Missouri
Hi there, I have a general question to ask but before I do let me explain the incident.
Back in November I signed up for this prepaid card called greendot and got it in the mail. well I used it on some website and somehow someone has done something to frame me. Recently I received a call from someone in New York threatening to press charges on me for fraud of $2,500. according to him I posted an ad on ebay selling a camera for $2,500, than tricked him into using moneypak and than proceeded to apply the moneypak code to my greendot account than withdrawed it all the same day. I've been banned from ebay over a year now and haven't done anything with ebay since 2012, and according to him the police have me on camera withdrawing out all of the money, he said I have a week to pay him $2,500 back into his paypal account or else he's going to press charges on me. What do I do at this point? Do I give in and pay even though I've never dealt with this guy or seen this guy before, or ignore him and see what happens?
Re: Accused of Defrauding Someone of $2,500
That depends on whether you are guilty. If the evidence of a crime exists you can potentially be in serious trouble. On the other hand, if he is making it up, you should have nothing to worry about.
Re: Accused of Defrauding Someone of $2,500
If you didn't do it and it he is blowing smoke. Frankly, I have my doubts because if the police had gone to the evidence of pulling ATM videos, they'd likely be already prosecuting you rather than someone extorting you for a refund. It's the STATE that is the injured party in a criminal proceeding and the police/prosecutor is who files the charges, not the alleged victim, all the victim can do is make a complaint.
I however have some doubts about your story. Why would you "refund" something you never took. If by any chance you are the banned user on ebay with the same name as the id you are using here, you're lying to me.
Standard answer, keep your mouth shut until the police, prosecutor arrest you and then refuse to talk without a lawyer.

It sounds like you make a habit of this:

Question, is there a way to send it to my bank account? I have many paypal accounts but my legit one is banned for fraud until i pay off the 700 out of pocket(which i will never do because they are idiots and fell for my trap)

Good find Dis...yeah I thought it sounded fishy. Sorry, but this is not the HOW DO I COMMIT CRIMES AND NOT GET CAUGHT FORUM. Good luck to you. I hove you'll spend some time as a resident of the state.
