    My question involves labor and employment law for the state of: Illinois

    Hello
    I was given a 5000 signing bonus on my first paycheck and 5000 incentive bonus on the second and 3rd quarter after emplyment.
    I will be moving to another company after 8 monhts of employment.

    per my employment agreement bonuses must be returned to employer if employment is terminated for any reason before the end of the first year.

    Instead of submitting a resignation verbal or in writing. I will develop an ailment that will keep me from coming in to work.

    My question is. Can my employer enforce the contract if they can't prove I ended my employment? in other words if I am sick and there is no resignation letter from me or termination letter from them. How can they come after me in court or trough collections?

    The bonuses total 10,000

    If they did come after me how could i drag it along so as to discourage them from continuing with the legal process?

    also if they send me to collections how could I demand proof of debt legitimacy?

    Worst case scenario I am ready to pay the bonuses but i want to make it hard for them to come after me. at the same time i cannot afford for them to ding my credit by sending me to collections.

    You should run your contract, and your plan to fake an illness, past a lawyer in your state.

    No, I could also just leave the country, or I could quit verbally.

    the point is I will not give them substance to prove in court my employment has been terminated.

    You seem to be missing the point the purpose of this forum is not to assist people to break the law or commit fraud against another.

    You know, if you really truly think that as long as you don't actually say or write the words, I quit, they can't prove you're not employed there any more, the only lawsuit you should be considering is the one against your middle school, or possibly your parents, for failing to teach you how to use your brain.
