Will You Go to Jail if Caught Shoplifting While on Probation
My question involves criminal law for the state of: Georgia
My son is 20years old now. He got caught on october 2013 for shoplifting and amount was less than $300, was not arrested. He went to court last month then got arrested, mugshot, probation for 3 months. Yesterday, he got caught again in different county by shoplifting and this time less than $50. I assume officers did knew about his past crime but did not know about his probation. They told him its like a traffic ticket,
will be just a fine and need to appear in court. I am so worried and could not sleep last night. Amount is small but still shoplifting and he is under probation. Is he going to okay? Or he might go to jail? Please help what might happen to him..

Your son needs to notify his PO of this violation. Better they hear it from him than find out themselves.
He could be facing probation revocation for this, depending on how tough his PO is. Will it happen? Who knows.
The court will see that he is currently on probation for another shoplifting charge. A day or two in jail may be seen as a wake up call by the judge. Will that happen? Who knows.
Just out of curiosity, was this in Metro ATL?

The fact that it's the same offense for which he in on probation, is not a good thing. It gives the impression that probation is not enough. The municipality for which he committed the subsequent offense could very well know about his probation. It could be that they know that his violation will come when the PO spots this offense. He could be sentenced to jail for the new offense and still carry on with probation. He could be placed on probation with the new county and still have probation in his original county. He could be sentenced to jail for the original offense and placed on probation for the second offense. Lots of possibilities.
