Getting a Visa to Get Married
I was in USA for 15 months on J-1 visa and during my stay I've met a girl there. Now I'm back in my country, but I want to go back to her to USA. Can you please help me and tell me what are my options with visas I can apply for? I can't find anything. It's practicaly not possible to get working visa, I already had J-1 visa and for student visa I don't have money to study there or any sponsor. Looks like the only way is probably marriage, but we didn't want to do that right away, so I really hope there is some other option for us. But anyway my other question is - if there really is no visa for me, can I go there as a tourist on waiver program and get married? Would I get a greed card? I swear I don't want to do anything illegal, I just want to be with my girl, I wanna be treated as any other person, I'm willing to pay taxes and everything, I'm not interested in thriving on USA, I just don't know what to do!!! Please help :(

Entering the country on a visitor visa (or the VWP) with the intent of getting married at some point is expressly forbidden.

You might have to deal with having a long-distance relationship for now.

Have her file for a K-1 fiance visa for you. It sounds like you spent enough time together it will be approved as long as you can fulfill the affidavit of support.

And how can they prove that it was the intent?

This girl, what is her status? Is she a citizen? Permanent Resident? Another non-immigrant visitor?

As stated, if you come to the US with something that appear to be immigrant intent, you'll violate the provisions of the VWP and that will cause you problems going forth.

OP did state that marriage isn't on the cards right at this moment. Which does generally limit your options ;)

Do you have the 2 year home residency requirement? If so, you will not be able to live in the US after marriage unless it is satisfied or you receive a waiver.

If not, do you have the qualifications for an H1B visa? If so, find an employer to file for you on April 1 for start of work, if approved, of Oct. 1.

Green card possibilities depend on whether she is a citizen.

She is a citizen, she was born and raised in US. I don't know if I have 2 year home residency requirement, how can I find out? I was in US on J-1 visa and after one year we extended with company for another year, but I left only after three months, we ended up cooperation with company on my request and I was told I have to leave or I'll violate the program so I did. I graduated bachelor degree in my country, so maybe I'm eligible to get H1B visa, but it seems pretty difficult, only for doctors, architects and some special occupation. I graduated business school...

I was in US on J-1 visa, after a year I extended for another year, but after three months I ended cooperation with the company on my request and they said I have to leave or I'll violate the program so I did. May be I'm eligible for H1B visa, I graduated bachelor's college degree in my country, but they don't have to accept my degree and I can't find any job, cause I'm not a doctor or an architect or IT specialist, I graduated business school. My partner is a citizen of US, she was born and raised in US. Also I wanna ask about previous comment - how can somebody prove I came there with an intent to get married? I know that people travel to US without working visas and stuff and still get married.
Thank you so much for your help, I appreciate it a lot!!!
