Am I Eligible to Expunge My Misdemeanor Domestic Violence Case
My question involves criminal records for the state of: CA
I have a pleaded guilty misdemeanor more than 3 years. I am paying off the restitution this month. I want to expunge my case. But I have a 5 year probation that have not been reached. One year ago, when I meet my public defender, she told me after I pay off the restitution, I can expunge my case. So it is the time to make a try.
Do I still need the same public defender to help me? Generally how long does it take to expunge the case and will it be decided in one hearing?
Many thanks.

You must be finished with your probation and have paid all your restitution. See here: http://www.courts.ca.gov/1070.htm
Re: Am I Eligible to Expunge My Misdemeanor Domestic Violence Case
Thanks,
restitution will be pay off soon. The only thing is the probation not yet finished. I dedicated asked the public defender whether I can expunge my case before the 5 year probation. She said yes to me. Since she helped my case in a very responsible way and she is the only trial public defender in the local court, should I take her word seriously?
