    Does a Father Have to Consent to a Child's Name Change
    My question involves name change laws in the State of: New York

    I want to know if need biological dad permission to change my daughters last name and give her
    my husband last name. I have full custody through court for her, he is suppose to pay child support, but
    owes about 22,000 in back child support, has not seen my daughter since she was 3yr old and she is now 15yr old,
    also my husband been in her life since she's been 3yrs old.

    I do not know where is her biological dad is, was in prison some years ago do not know anything about him anymore.

    What do I have to do to proceed?

    You must file for a name change with the court. They must determine it is in her best interests to grant it. At 15, she will soon be an adult an the issue should not matter. You have not indicated what SHE wants.
