Caught Shoplifting for the First Time, First Offense Ever
My question involves criminal law for the state of: Wisconsin

OK so I am 19 years of age and this all happened at Walmart. I just got caught shoplifting for the first time ever. Stupid of me and I defenetly learned from this. I was taken into the room where they do all the processing and I complied to all actions with no arguing as I waited for the police officer to come. I was given a citation that I do not have to go to court for. Now, first how long do I have to pay this? Should a fight it?(Probably shouldn't do that.) If Walmart tries to charge me themselves am I required to pay them in the state of Wisconsin?

This is my first of fence so I'm really scared and I have no idea how it works.

It's called a civil demand and why shouldn't you pay it?

You mean you've shoplifted before and this is the first time you got caught?

The irony.... Apparently, you were destined to learn some more... I assume you meant to say "definitely".

You are expected to comply, by the way...

I'm going to leave the court question and how long you have to pay for it question for those who now more about this than I do... Main reason why I posted was because I found this statement of yours pretty interesting

I don't even know what it was you shoplifted... But, if I stole something from you, IN Wisconsin, would you expect me to reimburse you?

If your answer is yes, then I suggest you be prepared to pay... In fact, maybe you should pay Walmart without them asking you. But I suggest you mail them the payment... As I suspect you have been banned from all Walmart stores...

When you first started your thread, you probably saw three stickied threads at the top of the same forum, one is titled: Consequences of Shoplifting... The other is titled:Advice to Shoplifters.... You should probably read them and I'm sure you will learn a thing or two...

I'm sorry....but I thought the purpose of this forum was to give advice, unconditional and without judgement. Someone just admitted in a previous forum they give advice here AFTER being arrested. And almost every post I read, is mean..degrading and embarrassing. Yes, breaking the law is wrong..yes, SOME people actually DO make mistakes and learn from them. If you cannot give good legal and unbiased advice here...then you shouldn't be here..period.

That would be me. Honey, we are all volunteers here. Me from being on the criminal end, others from being on the legal/loss prevention/police end.

You were thinking of psychotherapy. This forum is about providing legal information.

Sorry that you don't like being judged, but... what's the guy called in court who sits behind the bench, wears a robe, has a gavel, and sentences defendants called, again? Better here than there.

Yes, the judge can be a lot more blunt.

So you ^start^ with not wanting to be judged...

But immediately in your next sentence, you are being judgmental:

And then you do your 180 twist once more and go back to preaching:

yes, SOME people actually DO make mistakes and learn from them.

Well, what if the person who was arrested had made that mistake, learned his/her lesson and is here to share form his experience and what he/she learned from it?

And by the way, "mistakes" that one supposedly learns from, should by definition only happen once. Any reasonable human being would realize that shoplifting is wrong, and even if you don't get caught, the guilt trip should be enough to not shop lift again.

In contrast, "habits" do not fit that criteria.... Worse yet, "bad habits" are totally out of the question.... They are "bad habits" that you keep repeating again and again.... So going to your own post in your other thread:

    Quote:

Even worse... "horrible habit"... And this time, it conveniently was a:

    little box

Which when you moved your arm, "it":

    fell right into my purse

Riiiight.... And we are all gullible here...

You should quit your holier than thou attitude because obviously, you are not one to judge!

But let me ask you this... Here is the entire paragraph:

I have a horrible habit of placing things under my arm, realizing it then turning around back to the counter and paying for it. Well yesterday, I did the same exact thing..but when I moved my arm the little box fell right into my purse and the alarm goes off.

How is it that when the little box which you had concealed under your arm, fell into your purse, how did it cause the alarm to go off?

Or did you leave out the good part of the story where it actually didn't cause the alarm to go off at that moment. Instead, what happened was that you concealed the little box under your arm, shortly thereafter, you intentionally moved your arm causing it to drop into your purse, and probably have done so at least once or many times before, only this time, this little box had a security tag in/on it and while you claim you always return to the counter to pay for your under arm acquisition, yet this time you actually did not do the same exact thing, instead, you were almost out the doors, at least past the security sensor before you returned to the counter ; this time, had it not been for the alarm, you would have been gone... I mean its worked before, why not this time!

Leave all that aside... Can you explain why you started your post with this:

    Quote:

I am a 44 year old woman living with my disabled father who is a complete idiot.

Is that how you always introduce yourself?

You start out by being the epitome of disrespect to your own parent and you expect people here to treat you kindly and be respectful, unbiased and nonjudgmental? You're here to test your story out and if you can't tell, my advice is that you should think of a better story, or better yet, you have the right to remain silent and not incriminate or perjure yourself.

    And lastly...

Of course thee is another alternative... You could "not be here"... That would solve your issue as well!

Good catch! I didn't realize that she was the idiot who was using the "put it under my arm instead of into a cart" excuse - which have seen a zillion times.

Honey, I have been here nearly 5 years since I came here to ask my own question. I stayed to not only thank the people who gave me advice, but to share my experience with others. I do not get paid a dime for the time I spend here.

Believe me....in that time, I have read every scenario possible. Some have been sooooo unbelievable.

    The biggest excuses:
    - My 3.2 kids were running wild and distracted me enough to push a full cart of groceries outside and to my car, loaded my car, and I did not notice!
    - I take medication for (insert illness), and forgot to pay for my entire cart of groceries. However, I was able to drive to the store, load up a cart with what I wanted, (then I forgot to pay due to my medication/illness) but was able to get out to the parking lot, remember where I parked, and start loading up my car when these asshole Loss Prevention people approached me....
    - The shopping cart had small holes, so I placed 20 pairs of earrings in my pocket/purse instead, and then someone called me on my cell phone and I forgot about them....
    - I went shopping with those reusable bags and loaded all my stuff into the bags, loaded stuff onto the conveyor belt, but forgot a few were still in the bag.....
    - I tried on a new pair of shoes but wanted to make sure they fit well. I left my own shoes in the box, in the shoe department, and when I went to leave forgot about the new shoes.....
    - I went into WalMart for three items, but found some stuff on sale. So I needed a cart. I walked past the cashier and the greeter, and how dare they have me arrested. I was just going for a cart, honestly.
