Accident After Trying to Block the Other Car from Changing Lanes
My question involves a traffic accident in the State of: California

I'm trying to figure out who is at fault with this accident and how the insurance companies will look at it...
I was driving on the 55N and the other driver was in the carpool lane. Stop and go traffic, raining but overall we were moving REALLY SLOW. Anyways, the carpool lane is protected by double yellow lines. I was in the "fast lane" and the other person was trying to cut over from the carpool lane to my lane.
I wouldn't let the driver in since he was being a JA and honking at me. I finally get to move forward so his car is completely behind my driver side rear passenger door. Since the car wouldn't let him in behind me he literally intentionally ran into my rear quarter panel. The impact was pretty much completely right in the middle of the rear between the bumper and the side.
When I talked to my insurance company they said that he was at fault but then they spoke with him and he is fabricating a completely different story. He is saying that I was merging into his lane and the rear of my car hit his passenger side. Damage on his car was passenger corner right below the headlight.
I've attached pictures so you can see the damage... It's barely noticeable.

NMine is the darker BMW and his is the VW. I know he did it on purpose since he was fully stopped and on his horn the entire time then tapped me. It's so infuriating knowing someone would do that. :mad:

unless you have proof from some other source, it may be that each insurer denies fault for their client. At that point, you use your insurance to pay for your damages and if your insurance company wants to chase it, they can go after the other driver.
