Do You Have to Pay Child Support if You're Not on the Birth Certificate
My question involves paternity law for the State of:
Husband has been paying child support for the last 5 years but is not on the B.C. He had a baby with another girl before me and she has ordered him to pay child support. We live in California and she lives in Georgia. Does he have to pay child support even if he is not on the birth certificate and has been paying child support for the last 5 years?
Re: Husband Has Been Paying Child Support for the Last 5 Years but is Not on the B.c
If there's a court order, yeap.
If there is no court order, you can almost guarantee Mom is going to file a paternity suit.
Re: Do You Have to Pay Child Support if You're Not on the Birth Certificate
If by "she has ordered" you mean a judge has ordered, then it is likely that paternity was established through judicial proceedings but that for some reason nobody forwarded the result of those proceedings to the department of vital records to have the birth certificate corrected.
You failed to follow the instruction to identify your state. You should do so now.
