Hit by a Car that was Changing Lanes
While driving down a three lane road I was in the far right lane and another car was in the center lane. While driving the speed limit the other vehicle without warning smashed its passenger side front end near the headlight into the side of my car into the center of my doors denting it and scratching the entire rear quarter panel. When confronted they started to slightly pull away until I pointed at them to stop. They then backed up there vehicle in rush hour traffic to the side street to get off the main road from delaying traffic. The vehicles air bags did not deploy and they were both still operational mainly cosmetic and no one was injured. I contacted the police and when they had arrived the other driver claimed I had switched into her lane when I did not do so at all. The Police Officer gave us both Vehicle exchange forms for insurance stating that I had to give her my information since she would not admit to hitting my vehicle with her friend in the vehicle who had claimed the same story. The officer said we have to file a claim with each of our insurance companies and they would decide who was at fault while the officer ticketed neither of us. When she should have been honest about damaging my vehicle when she denied it and lied. When I contacted my insurance agency they claimed I can either pay my deductible or file a claim for the other parties insurance. When I contacted the other persons insurance they had me file a claim explain what happened and would have an adjustor contact me in the next 48 hours. I am curious what do I need to do to prove she hit me so I am not forced to pay for my vehicle when I am innocent. Also what should I expect from the adjustor and how is this fair.

Re: My Vehicle Was Hit by Someone Changing Lanes and Denies They Did It by Saying I D
As you were told elsewhere it appears you are also at fault. You refused to provide the location and direction of the accident so anyone could provide a hands on assessment. Based on the evidence you did provide you are going to be found partially or completely at fault by their insurance. It is a waste of everyone's time to go through your repeated claims you know you are right and not at fault.

I was traveling southbound on a main street I was also the one who was hit how can there be no one at fault if the evidence shows I was hit. What if an adjustor were to determine the angle the vehicles were damaged and contacted? I understand there are no witnesses but how can someone hit another vehicle and not be at fault? I don't get how someone could be so dishonest.

For the fourth time on 2 sites, give us the street(s), city, state and location/direction you were traveling. You both managed to hit each other.

How did I manage to hit someone while I was maintaining my lane while going the speed limit. Get real.

You say they hit you, they say you hit them. Without 3rd party witnesses it comes down to he said she said. Unless you have proof such as video recording or something else you won't win this argument.
Actually your description of the damage would tend to lend more weight to the other drivers argument as they would have been in your blind spot while they should have been able to see you clearly. I'm not saying who hit who and I have Zero experience in accident reconstruction, but if I was asked to look at the damage alone without speaking to either driver I would tend to think the odds were leaning toward the fact that it was your fault.
So again without witnesses you're probably screwed.

Obviously, if you were so confidant, you would provide the requested information instead of repetitively insisting you are the victim. This seems to clearly indicate you know we will discover facts proving your culpability.
