Accused of Embezzlement and Caught With the Money
My question involves criminal law for the state of illinois: hi
My friend did theft worth of rs 151$ at walmart, there is no video on this but was caught stating that someone complained while she was stealing. walmart person called into a room and checked her bag for the worth of the same 151$. she admitted there being her first ever offence, she is above 18 . she is an immigrant. the police handcuffed and took to the police station after taking the id and other details. they did not take the ssn but the state id. she was taken to the police station and was left there for an hour and then a cop came to ask for a bond of 150 dollars for which they asked her to go to the court. her fingure prints were taken and tresspassed not to go to walmart again.

all my question is what will happen now . should she talk to the lawyer or just go to the court.
all her records are clean no bad records anytime.

she was all in frustration and she did this for the first time ever.

    please advise on this

    thanks

Hire a lawyer. Stop lying to everyone saying this is your first time. You can get up to a year in jail and fined up to $2500 unless you have been convicted before. Then it is a felony of up to 3 years.

OP may need to see an immigration attorney, too.

That $151 may cost much, much more...

You were not found out by a customer. Walmart employs security that dress as plain clothes officers. I know, I worked there in college. If and when you are found guilty of misdemeanor retail theft, you will most likely be placed on supervision. Some counties will require you to enroll in a theft deterrent class, You will not be eligible for expungement for 5 years.

Just Theft (Third Degree). Hawaii doesn't have a specific embezzlement statute. The shoplifting statute just is a penalty "enhancement" to the theft charge that limits the fine. However, this is likely going to be prosecuted as regular theft and the full $2000/year in jail penalty is on the table. Don't know if any counties will offer shoplifting diversion to embezzlers. You need a lawyer.

Ah, so you are right. The Hi is just the first word of her post that got glommed on to the previous line. Sorry about that. Only one Walmart in Hawaii (on Maui) anyhow.

Just FYI, we all know this was you and not a mythical friend. That device doesn't fool anyone.
