Charged With Larceny but I Didn't Intend to Steal
My question involves criminal law for the state of: North Carolina.
Okay, I was in Walmart and had ordered Wing Dings and Potato Wedges. I also had a McDonalds cup in my hand. Now in this Walmart there is a McDonalds but this is not the same McDonalds that I ordered from and everyone knows its against there policy to get refills from other McDonalds let alone leave the place and come back expecting a free refill. So I walked to the cash registers and thought about buying a 20oz but then remebered there machines out in the foyer. I then proceeded towards the machines and was stopped by walmart security. The food was in my hands, not concealed and the mcdonalds cup as well. I was heading to there drink machine to purchase a drink. I just got past the alarm system in the direction of the drink machines when a walmart security guy stopped me. He grabbed me in which I understand is illegal because they can only keep you from leaving the premises. Also the confined me in a small room which is also not within there rights due to federal statues. They are allowled to keep you on the primises as long as you not trying to leave. This is a bunch of crock. Am I xorrect on fighting this. They even watched me walk through the cash register area where the drinks are. Idk. Im heading back into court. Need help asap......

You are operating under misconceptions. NC state Merchant Detention stature allows for them to do what they did.

I don't think stealing requires "intent."

Did you pay for the food at some point before walking through the registers to the soft drink machines?
