Accused of Making Terroristic Threats After Confrontation With A Stranger
My question involves criminal law for the state of: NY, (and yes I am a foreigner and yes I am a muslim)
Sorry I am a little in shock, so my writing is not going to be perfect: So I am in my 75k car riding with my show dog, and the dog decides that he has diahorrea and poops in the car. I open the door for him to relieve himself out in the slushy snow. While I frantically try to find a place to park in the parking lot, a lady starts to follow the dog. So yes, I am frantic right now (I shouldn't be, but here I am), by myself with poop everywhere and thinking what to do. I call the dog loudly, so he doesn't go out of my sight, and start to lay a blanket on the dirty slush, so can clean the dog first, clean the car second, put him back in the car third, clean the street with poop fourth.
The dog obviously is frantic as well, like his owner, guilty of the mess. The crazy lady in the meantime has no idea of whats going on, now comes, with hands at her hips, stand in my face like a 'bulldozer' and tells me not to 'abuse' my dog. I tell her first politely to not accuse me and to keep outside my business and that I have a mess here to solve. She does not pay heed to me. So at this point I lose my calim and say 'get lost you bitch'. So that was my worst offence.
She immediately ramps up the situation and yells, 'I am not going anywhere, I am going to watch you, people like you need to learn a lesson'. I again shout, 'I said, get lost'. She pulls the blanket that I had layed down and now contains poop, and throws on my face. I now start dialing 911. She as wells starts dialing 911. Police comes. I am in my car and she is in her car with her husband.
I tell the lady officer my version honestly, but she questions me, why I called her a bitch and tells that animal control will visit me. I said, 'fine, no problem'. I tell her to see my dog, how well he is taken care off, few dogs are so well taken care off. However she is not interested in interviewing him.
In meantime, she tells officer that I was beating my dog and she was stopping me, which was 100.00% a lie. I tell the officer that is completely not true. Officer asks, why would then that women make such a claim. I said, I dont know, but I think she is a 'rascist' and that is why she cannot fathom a person of my appearance with such a good looking dog and car etc. The officer takes exception with my characterization of her as rascist. Anyways, she asks me to leave.
As I try to leave the scene, and open my windows to tell the officer of a witness (shopkeeper), the husband pops out his head and says: "you watch yourself now". I just now stare in amazement, how foolish he is. He again yells "you watch yourself now for threatening my wife". By now, I have totally calmed (realizing poop is all good as there is more at stake and amazed how the other party is killing their own case). I tell the officer to take note of the husband's statement.
As I reach home, I call the officer, cause there was voicemail. The officer tells me, the wife/husband are adamant on pressing charges against me for 'terrorist threats' to their family. Now I am really awestruck. I tell the officer, 'see you were offended by my characterizing her as rascist, and why do you think she would such belatedly make such an attrocious claim?'. I remind the officer, that all the claims set aside, the police didn't witness anything either the womens story or mine. But they did witness the husband, him shouting 'You better watch yourself now'.
I remind the officer, isn't that a threat?. And something that was given in "front of the officers", something that there is a clear witness to. Officer says no, husband is merely protecting the wife. The officer says that anyways, both parties have it wrong, and they will not file the police report and advise her to drop her claims. So I am free to go and no animal care will be visiting me.
So I apologize for this ill-written long story. But I want a learn some lesson from it. What rights do I have in such a situation? The women clearly made a very serious charge of 'terrorist threat'. I was fortunate the husband spoiled the claim with his own actions in front of the cops, otherwise I would have been badly badly screwed - consequences beyond my imagination. Obviously for a muslim, even a bleeding liberal like myself, the crime would have fit my name.
So what I want to know is for future:
- can someone so easily make a charge to police for 'terrorist threat'
- cant I as well file charges too? the police seemed to give impression, only she can file. (and that I shoudl be glad, they are playing a role to end the episode)

What a lovely story.
1. People say the oddest things at times. Sometimes this is actionable, sometimes not. Sometimes people file ridiculous petitions and get laughed out of court and possibly ordered to pay the other side's legal fees.

No. People can make claims, and the police can forward reports to the DA, and the DA can decide whether or not charges will be brought forth. No DA worth her office is going to bring forth such charges over calling someone a bitch.
Frankly, I don't think you're telling us what really happened.
So did this actually happen, or are you the latest in a long string of people looking to play lawsuit lotto?

By the heavens, I dont know how to assure you, this is indeed what really happened. I am laughing myself, but I am shaken too. My day is spoiled, I was working from home, and had to cancel all my work meetings :)
But I assure this is indeed what happened. Offcouse there is more description/words to it, but this is it, the best I could describe.

I am at a loss, 'Law Missy'. I use a VPN network, but dont know what that has to do with my post, my location or my experience ... which are all real. At first I took your response as a positive learning, but now I suspect you were pissed at my experience .... strange ... I dont know what aspect of it made you so bitter :) the 'b#tch' comment or the 'muslim' part or something else :)
