What Happens After Divorce Papers are Served
My question involves a marriage in the state of: New York
I am having my wife served papers this week.
And while I realize that no one can give me exact dates and the like, I'm curious.
Typically, how long after being served does a hearing take place ?
What happens ? What's the process ?
And does anything I'm requesting in the petition (exclusive use, home and children) 'happen' once she is served, or is that what the hearing is for ?

Your wife will either answer the complaint, or not. If she files an answer, the court should schedule a hearing. If not, then you would want to seek her default such that the divorce proceedings continue. The speed at which the case progresses depends on factors including the level of congestion in the court's docket, the complexity of the case, and your own diligence in properly drafting, filing, and serving the various documents and pleadings necessary to complete the case.
If you want to file a motion for exclusive possession of the home, you would need to schedule a hearing on your motion.
