When Can a Minor Get Married or Emancipated
My question involves juvenile law in the State of: Arkansas
I am 16, fixing to be 17 in a month. My fiance is 18 and we've been
together going on a year and 2 months. I am 7 months pregnant
and wondering about the minor marriage laws. Reason for my asking
is because my dad (who is JUST my temporary guardian) told me
and my fiance that if he joined the military then when he got back from
basic he would sign the papers for us to get married. Well, he's coming back
from basic in 3 days and my dad informs me that he is NOT going to
sign the papers for us, but instead keep me under his household in charge of
my fiance's money and bank account, and says my fiance has to
"prove" himself first. There's a slight problem with me living with my dad,
there is physically NO room for another person (no matter how small she may be)
As of right now my stepmother's parents live in our front yard in a camper
because they cannot take care of themselves, my house is 3
bedroom and every room is filled. NOTE: I have one sibling. And my room
alone is big enough to fit a twin size bed, a dresser, and a night stand.
Clearly, no room for a baby. On the plus; my fiance has a job, a car, pays for his, mine and our
baby's insurance and we're in the process of buying a house. We are buying
it off of my grandparents(my moms parents) and have 5 years left to pay.
I read online and it says you only need consent from one parent IF your parents are
divorced, seperated, etc. but what if your LEGAL guardian lives in another
state(Oklahoma) but you live with your other parent? How would that work?
Is it mandatory that my dad signs for us or is it kosher if my mom signs?
IF my dad MUST sign for me, then what are the emancipation requirements?
I have a 4.0 GPA and am taking freshman college classes and have transcripts
for proof if needed, I have my DL, military ID, Birth Certificate, and Insurance cards.
I do not work though, because all places that hire minors do not hire pregnant
minors, "because it is easy for problems to happen and the company could be sued."
I'm in desperate need of help and answers. Any information good or bad is greatly
appreciated.

You are not getting married before age 18 without parental consent. Just because you live like a hillbilly is not grounds for emancipation. The fact that your boyfriend sends you his money is not grounds for emancipation. Frankly, your being knocked up and living in a pig sty will likely result in the child being removed for its own safety. You exhibit several clear indicators you are not responsible enough to care for a baby by any stretch of the imagination. Nor is your family or his family.

no he doesn't. Your baby doesn't have any insurance.
and depending on the your custody situation, either your dad or your mother and father would have to give permission for you to marry at 17 (presuming your father is the custodial parent)

just because your mom gave birth to a bastard like you with a one night stand with hillbilly doesnt mean everyone is a hillbilly you moron.

Awe, poor little girl. Does the truth hurt? Open the window, I am sure that place smells like last weeks garbage. I worked in the Rock for a while. I met a few people that lived in those crap hole houses, with the floors rotting and the roof leaking. Make sure the blue tarp on the roof is secure. Is that daddies new fishing boat in the yard?

On a brighter note, I learned where some awesome cat fishing was. You could catch a nice one quicker than you could bait your hook.

A dependent child with a baby of her own that she cannot independently support has a zero percent chance of emancipation.
If your mom accompanies you to the county clerk, with a certified copy of the custody order granting her sole custody, you may be able to get a marriage license. See Arkansas Code, Sec. 9-11-102.

Actually, it sounds like her and her boyfriend lied to Uncle Sugar and said they were married to obtain benefits. I think she will end up in Club Fed while he is doing his time in the brig.

Okay, one I am not a backwoods hillbilly. Just because the house if full and
my grandparents live in the front yard in a camper does not define me or my family
in any way. They are senior citizens who cannot take care of themselvesr.
Two, I am not "knocked up". If you had any literate knowledge you would
know that being knocked up is getting pregnant while intoxicated by someone you barely know.
I CLEARLY stated me and my fiance have been together for a year and 2 months. As for you saying
I am incapable of providing for my daughter, I would like you to take a step back and
simply shut the hell up. Frankly, you do not know what I am capable of. Thirdly, my dad is in the
military and THAT is how I got my military ID. I had my permit to drive at 14 and got my license
as soon as I turned 16. As for my dad controlling my fiance's online bank account, I had nothing
to do with the set up of it, or let alone even knew of its existence, until about a month ago.
As for trusting me with his money, I see he has no issue there. So, you can stop downgrading
me, when you do not know me. Also, me being "Club fed" would you care to explain what
that means? I do not know "hillbilly" terms. And getting benefits, I don't even qualify to receive
government help. I'm glad you took the time out of your day to make yourself
appear to be a complete illiterate asshole. It definitely made my day.

Regardless of all your banter, the law is clear, you must have permission from either both parents or the custodial parent in a seperated parent situation if there is one parent with sole custody.

I find several of the comments on this thread to be quite distasteful.
"Fixing to" is a common southern phrase meaning "about to" and is used by both well educated and non-well educated people.
Those who chose to make bigoted remarks should be ashamed of themselves.
