    Will You Still Get Paid for Vacation Time if You Quit Immediately After Returning
    My question involves employment and labor law for the state of: I'm going on vacation and when I get back I want to quit. I'm going to work 2 days than I will quit will I still get paid for my vacation hours or will they take it from me because I only work 2 days from coming back from vacation. Please help me...

    In what state is this? It matters.

    We cannot tell you what your employer will do - the crystal ball is out being recalibrated. But if you tell us what state you are in, we can tell you what the laws are regarding vacation payments.

    Florida has no laws about the payout of vacation. Sorry, there's no way for us to tell what your employer will do.

    If you have vacation time accrued and take it and then quit two days after returning, they should pay you barring any contracts you have.

    That being said, that's a dick move. Give a proper notice. What kind of job is it?

    They should, yes. But if they don't, her options are limited to small claims court because neither the Feds nor the state of Florida is going to do diddly about it. And it's by no means certain that she'd win in small claims.

    Agreed. There are no federal rules on this. And very few states have rules requiring the employer to make such payments absent an explict employer policy. Basically CA and a few other states (not FL). Some states have a "follow your policy" rule. FL however does not have any such rules. If the employer has a formal policy to that effect, then small claims court becomes a possibility. I worked for an employer with employees in 34 states whose policy was to buy out vacation balances upon termination only when required by state law. And this was a very legal policy that was indeed tested in court.
