law enforcement cannot reduce crime since they are not who is committing the crimes. All they can do is arrest those that choose to make themselves criminals.

Sorta good evidence that you violated the law by possessing a firearm! The only thing in your favor is that they likely cannot tell with certainty that the gun was a REAL firearm or when/where the image was taken. Unfortunately for you, the image likely has tags that will allow them to determine the date, time and location of the image, but (obviously) not whether it was real or not.

And one proven crime prevention tactic is the suppression of crime through the arrest of perpetrators of crime. When you arrest and convict someone they aren't committing more crimes against the public while they are incarcerated. And, the arrest in and of itself can be a deterrent to potential future ne'er-do-wells. Silly, I know ... :cool:

Is this your way if saying that because I am a convicted felon I am guilty if just about anything you can imagine. I was 21 years old when I was caught with over ounce of mj. I am 31 years old and deserve to have all of rights restored to me. Also take into mind that this is ca and mj laws ... There are stores all over the place selling it which is crazy and should be illegal. There should be no arguing the fact that mj should be illegal but it is legal anyway. Does anyone else think that it is crazy that Somone can walk into an office and an hour later walk out with over an ounce of mj but the same person convicted of doing this 10 years ago cannot walk into a store and buy a gun.

My record has already been expunged entirely!
We know from the other forum that they were not, hence his questions about the penalty he would face if caught with a firearm and what would be involved in obtaining executive clemency.

Not at all I have verified that my record has been expunged in person at the clerks office.
Bottom line? It is simply a matter if filing another paper which was in the process of doing but one of the questions asked for arrest dates and descriptions since conviction. I did not have that info since I was never actually convicted of anything and the police department wouldn't release it therefore it was never filed.
You stated down the hall that you could not get one of your wobblers reduced to a misdemeanor. As long as that felony is there, no guns for you.
So the PD didn't want to release publicly available information? March on down to the courthouse where you were convicted, or consult your paperwork from the cases. Hint for your future convictions: Save everything from the case as you never know when you might need it.

I had been arrested once since my conviction but never charged with an actual crime. I am sure my record has been "expunged" but the mj charge is not reducible.
But you were convicted on your previous charges, so you were in fact convicted. You have simply gotten the conviction expunged. But apparently not all of them cause you still have that felony conviction. Which will continue to bar you until such time as you are pardoned. So basically forever.
I couldn't file the pardon or certificate of rehabilitation without that info but keep in mind I was not in possession of any firearms! On the pardon it asks for specific information on any arrests since conviction. When contacting the police department they said they could only release such information when inquired by an agency for such things as employment.
So go to the court where you were charged and check the file.
You also need to understand a pardon is not guaranteed. You can apply but I wouldn't hold my breath.
Alfter all of this I would just like my cash back. This is very stressful and with the holidays approaching I should be entitled to damages caused by all if this. I shouldn't have Been searched to begin with and the police should not have searched my phone.
As has been explained to you several times, go ahead and ask for it back. Preferably with a lawyer. Don't expect to get it back anytime soon as they appear to have an investigation going on you.

Fine, if you believe this was an illegal search and you just won the lawsuit lottery, go out and consult some attorneys. If they start arm-wrestling to get your business and agree to do it on contingency, you can leap up and down with joy. if they shrug, hem and hah, and then ask you for about $5,000 for a retainer, walk away.
