    Received Unexpected Civil Summons for Debt
    My question involves collection proceedings in the State of: Kentucky


    I received a civil summons from an apartment complex in Kentucky. I now live in Tennessee. I moved out of the complex in March of this year and had no idea that I owed a balance prior to receiving this summons. There is no court date, but it requires a written defense. My rent was always autodrafted, so I assumed that if I owed anything it would have been taken out.

    *** From lease agreement (Page 7, Section 8, Rent)

    "If Resident pays Rent by automatic withdrawal, Resident hereby authorizes Landlord to draft the account for all deficiencies owed under the Lease."

    Even though I am very unsettled that the plantiff neglected to give me a chance to pay the bill, I would like to just pay it and get it over with if possible. The total is less that $1000.00. What do I need to do? I don't have a lot of time to get this taken care of.

    Ask the plaintiff whether, if you pay the rent owed, they'll dismiss the lawsuit. Get any agreement in writing, signed by the plaintiff, before you pay.

    I attempted to contact the plaintiff. I am anxiously awaiting their response, since I do not have a lot of time to deal with this. Am I correct in thinking that it would also be in their best interests to allow me to pay the bill- rather than force me to seek legal counsel?
