Def. adjudication for shoplifting 21 yrs ago
21 years ago, at the age of 17, my husband was in a Target in Texas with his 21 year old cousin. The cousin decided -- hey he'd like a pair of cowboy boots-- and since my husband had his school bag with him, talked my THEN gullible husband (he has learned ALOT since then and because of this) into letting him put the boots in his bag. Before even leaving the store 'they' were caught of course. Get this though...his 'best friend' and cousin ran off and left him there. My husband never 'gave up' his cousin. Sounded soooo loyal at the time and of course now he wishes he had, but he didn't. They get along ok but it is NEVER mentioned.
Anyway, my husband (17 at the time) was arrested. He pleaded no contest, got 6 months probabtion (may have been a bit less-it was 20+ years ago!) and deferred adjudication. He has never had so much as a speeding ticket in the next 21 years. He is a model citizen, youth pastor, church deacon, has been an asst. director of a large children's home in south texas, worked for 5 years as a government contractor in a secure data centers on 2 different military bases, and currently is about to graduate college and become a teacher. He has had to have background investigations/checks in the past and most recently has had one every semester he has been in the 'teacher program' at the local State University. No problems reported. We have wondered in the past though when he would be turned down for one job or another if something showed up on his record. He is wondering now, since he is about to begin applying as a public school teacher in Texas, should we AND can we have his record cleared or supressed somehow to be sure? Where do we start? Do we need to have a lawyer or is it just a form you submit at the court house begging a judge to help you out :-)? Help!

ok...did part of it. went to Tx DPS site and checked his record. it shows the 1985 item. But it calls it LARC $20-200. Is that a Class C or B or A? He thought it was a C back then but just can't remember.
The CCH report says this:

We still plan to go to the city to check with the court it was handled thru like the post I was pointed to says to do, but we don't live there anymore so it will take some planning. Any help understanding the above is appreciated. I'd like to know what A, 23000000, a, and 312 represent. The rest is pretty clear. Hopefully A doesn't mean class A does it? Does the SEQUENCE CODE mean anything important here? Can I tell from this Tx DPS report what class the misd was?:confused:

He may wish to seek a consultation with a lawyer who handles the sealing and expungement of criminal records, who should be able to explain what the various entries mean. He may be able to find a lawyer who offers a free initial consultation.
