Limited Visitation by Ncp Now Asking for Joint Physical Custody
My question involves a child custody case from the State of: California
The NCP parent has a visitation of 4 hours Wednesday and just this week since our son turned two he has overnights Saturday to Sunday. We have a court date for December 20th and he is asking for joint physical I currently have primary physical he has not wanted anything to do with out son till the beginning of this year when he got married. He works out of town 25 days out of the month and is requesting Wednesday 3pm to Thursday 6pm and every other weekend 6pm Friday to 6pm Sunday and that his wife is allowed this visitation when he is out of town which is the majority of the month. Considering he only has been seeing our son 2-3 times a month for a couple hours at a time can he get this? I don't mind him seeing our son but I don't see the need for our son to be taken out of the only home and parent he has known, me, for no real reason. Help? I'm quiet nervous
EDIT: since my first response didn't understand my question what are the chances the judge will allow the visitation to go to the stepmom since the father is always out of town?

No real reason? He's visiting his FATHER, who happens to legally be just as important as his MOTHER. EOW (every other weekend) and one day a week is just about as common as brown hair. He's fulfilled almost a year of visitation, it's time for it to progress.
and you might as well start to get used to your child spending significant amounts of time with someone other than you. He may one day want to go to sleep away camp, or sleep overs or science camp with his school that is over one whole week.

I disagree with Courtclerk due to your specific set of facts. What dad is asking for is normal and appropriate EXCEPT that he wants his wife to be able to exercise his visitation since he is out of town 25 days a month. There is nothing normal or appropriate about that. Its also not necessarily normal or appropriate if the maximum time that dad has spent with the child is 2-3 days a month for a few hours at a time. If you argue this appropriately in mediation and/or in front of the judge its highly unlikely that a judge or court professional would agree that stepmom gets to exercise dad's visitation.
However, what you SHOULD offer is visitation that maximizes dad's time with the child is when dad IS in town.

Skype, phone/web visitation - all possible, too. And will likely make Mom look a lot more reasonable if she suggests it.

Stepmom not liking the child support obligation? Seems about the norm.

I suggested the skype and phone calls web cam father did not agree we have gone to mediation 2 times already

Dad wouldn't agree to skype and the like? Did he leave his brain in his wife's purse or something?!
With that said, I did misread the original post. While I agree that stepmom doesn't automatically get Dad's visitation, how many actual days/hours would Stepmom being looking at? Dad is out 25 days per month - that leaves at least 5 days (two weekends, theoretically) where he can exercise his visitation.

Yeah...I was thinking that too. The child is only just 2 and dad has only been exercising visitation 2-3 times a month for a few hours. Its not like he and stepmom have been married for 10 years and have a houseful of siblings to the child and dad JUST got a job requiring him to travel. This is ALL about child support.
