Do You Get Points for an Ordinance Violation, Driving in a Bus/Taxi Only Lane
My question involves a traffic ticket from the state of: California
City: San Francisco
I drove to San Francisco to visit a friend for an evening and upon entering the city I took a wrong turn, was confused by the lane markings, followed the car in front of me (i figured they knew what they were doing) while looking for a right turn to get off the confusing street, and we both ended up getting citations.
i'm a college student with little income coming in and i am part of a low cost auto insurance which i believe contains a clause where I can't get any points toward my license otherwise my coverage will end. naturally, i don't want this to happen so was wondering if anyone has previously had any encounters with this situation. From what i've gathered driving in a Bus/Taxi only lane is considered an infraction on a local ordinance and those shouldn't affect the point system. i've read through a few threads pertaining to TC 31 but was unable to deduct anything definitive.
Any direction would be greatly appreciated. Thank you in advance.

I can't find a section 31 in the SF Transportation Code. But, if this is a local ordinance violation, then it does NOT include a point on your driver's license.

thank you for replying! how can one know for certain that it is indeed a local ordinance? i'd like to err on the side of caution and know for certain that is a local ordinance.

If it is NOT a California Vehicle Code section that was cited, then it was a local ordinance.
What does it say on your citation?
And since VC 31 refers to furnishing false info a peace officer and generally results in an arrest and not a citation in the field, I doubt this was the section cited.
31. No person shall give, either orally or in writing, information
to a peace officer while in the performance of his duties under the
provisions of this code when such person knows that the information
is false.

That's not a Vehicle Code violation, so, no points can be assessed on your driver's license.

Sure ... VC 12810 et seq covers points, and they only result from violations of the Vehicle Code and two sections of the Penal Code (for manslaughter).

Driving in the HOV lanes in a non qualified vehicle does not carry any points even if you'd been cited for a vehicle code violation. The reason the cop cited you for that code section instead of the vehicle code section for this particular violation is likely to spare you from having to pay the HUGE fine that comes along with a 21655.5 violation.
The fine for a TC31 appears to be $60 or so...
The fine for a 21655.5 is $490

And! The city and county of San Francisco get more money to their coffers from that $60 than they do from the one that would cost you $490!
