How to Fight a Bay Bridge Toll Plaza Speeding Ticket, VC 22350
My question involves traffic court in the State of: California
Hi everyone, as my title states I got my very first ticket while crossing the Bay Bridge toll plaza through the FasTrak lane.
Time: 12:30pm
Weather: Clear
Traffic: None
City: Oakland, CA
Location: Bay Bridge Toll Plaza
Approaching the toll plaza the speed is 50mph and to pass through it is 25mph. Now, I drive a natural gas car so 90% of the time I pass through carpool toll lanes to the right which don't have a speed of 25mph. Although that's not what my defense is going to be just making a clarification. Okay so the CHP pulled me over as soon as I passed through the toll plaza and bs'ed basically a speed of 40mph on my ticket. There was no way I was going that fast because you have to slow down in order for your FasTrak to be read. Anyway, he didn't use a radar so that's why I'm saying he bs'ed and wrote down what he thought. I was most likely going 30-35mph to be honest. Anyway, since this is my first ticket I don't know what to write in my Trial By Declaration. I am lucky that he didn't get me on the radar though that is for sure. Just need some help. I really despise the guy, first ticket in 5 years of driving and I am 19 (almost 20 in December) so that is rare. I have a perfect driving record, not even a parking ticket in sight, thank the lord. I have posted the bail $238 but honestly I'm a college student who pays rent and I do not have this kind of money. Really would like to win this.

So he bs'ed and guessed 40, and you were only going 30 - 35mph.... But you are lucky he did not get you on radar? What speed would he have cited you for had he caught you on Radar?
You should know that 30 mph, 35 mph or 40 mph all carry the same fine amount... So it makes no difference whatsoever. So if he is going to make it up, then why not cite you for 45? or 50?

Also, far be it for me to burst your bubble, but being 19 with no traffic violations isn't really that great of an accomplishment. In fact, we are all expected to drive without ANY traffic violations at all... That is the standard. And some people go through an entire lifetime without any citations. And guess what, the greater likelihood is that your streak is over.

I'm not the moron who got ticketed at the toll booth then tried to claimed it was impossible for a car to go through that fast. Put on your Big Boy panties and try again.

I'm sorry I don't know how I replied to you. I meant to reply to the "That Guy" who was trying to be a hard***. Btw, I know I wasn't going 40, I never do, I wait until the light flashes for my fastrak to and then speed up after I've gone through. So it's legitimate to say I know that I wasn't going 40.

I apologize also. That said, again the argument it cannot be done is certainly not effective based on the link I provided. So back to your story.... By your own admission the error is minor between your estimate and his. Given only a 5 mph difference, he is the more credible of the two of you. Is there a difference in the charge between the two or will it change whether you can take traffic school?

I must be a real jerk, so much so that my wonderful neighbor who is actually of authority unlike you took care of the citation. ;) She must hate me and think I'm awful. I'm sorry you tried so hard to make me feel bad but didn't succeed. And oh, just so you feel even better about yourself, I'm a 19 year old girl not a "He" as you would like to think because you thought you were having some real macho duel here, and you, you're probably in your 40s-50s facing a mid life crisis because you're real bitter so much so that you like to bully children on the Internet.

Okay, let me clue you in on something. They do expect everyone to immediately jam on and engage their ABS or skid to a speed decrease of 25mph. They expect the driver to be mature and responsible enough to start slowing in the 50 mph zone, before passing the 25 mph sign. :wallbang:

I'd sure like to know who you know at the courts that would fix a ticket, because see... that's against the law and would land both of you in jail. Once a ticket gets to the courthouse the ONLY person that can make it go away is someone at the courthouse.

I guess you don't know what taking care of something means. :) It can be done legally and with good advice. Not by breaking laws. Lets just say it'll be my secret ;) and I would've passed on my advice but you guys apparently are class A traffic experts.

If by "took care of the citation" you mean she paid it on your behalf, then I'd agree she is a great neighbor... The fact that you are going to school trying to better yourself does not grant you a free pass on having to comply with the speed limits that apply to everyone... Neither does the fact that you drive a natural gas vehicle or that you are in the bay area.
As for you bad short term memory and not remembering your speed, were you lying then when you said you went through at 30 - 35 mph or are you lying now saying you don't remember? Either way, not to worry, that is one reason why the officer wrote it on the citation.
Think about this question as you sit there and sulk in your misery... If my opinion means so little to you (and I quote: "You're not worth this reply"), why are you making such an issue of what I post? Where do you get off thinking you are qualified to judge me? (Before you came back with the same question, I can judge you because you came here asking for an opinion about what you posted... You opened the door for others -anyone, really- to judge you by your statements) Why are my posts bothering you so much! Then again, your statement about despising the officer who cited you speaks volumes about you!

I am going to be the mature adult I am and tell you, That Guy, that you win.
Since you are so curious, someone of authority means any type of authority; ie a lawyer. Lawyers know what to say cause you know they went to school for it. I simply did what she told me to do because she has the authority as a lawyer to know what shes talking about. And since she knows what she is talking about and deals with the law, I know I will be just fine. :)
So quick to judge eh? We all wish we had someone to give us free passes but it doesn't work that way in life. If the law gets broken for one person, it should be the same for everyone. I know enough to know that.
