Push on the counseling...make sure that it happens or that you file for contempt if dad won't cooperate.

This is insane. Not what you said, mind you...but the way the system works. I'm more angry that I didn't have the backbone to tell the Family Counselor that I wanted to go before the Referee. I will figure out a way to afford a lawyer. A person who doesn't want help in Counseling won't get it. Anyone who has any familiarity with how Counseling works has seen this. They've thrown my child back into the lion's den and I let them by not finding a way to hire a lawyer and by being too spineless to speak up with the Family Counselor at FOC.
This is an absolute nightmare.
Thank you all for your comments over the past few weeks. I will of course file for contempt if Dad doesn't bother to work out the Counseling.

Is anyone familiar with "Forensic Evaluations"? This was suggested to me by someone I trust (and is competent in my mind) and I've been reading up on it. It sounds like a good idea! I'm curious what opinions are about this here?

Sounds like the judge agreed with my assessment, parental Alienation.
Do the counseling as the judge suggested, trying to twist things to make your ex look bad after the judge obviously pointed out that you were also at fault isn't going to win you favor in the judges eyes.

You've made your agenda quite clear. You might want to stop twisting posts to make them fit your agenda before the Ban Hammer descends upon your undefended head.
No judge was involved, a mediator was involved. There was also zero indication of parental alienation as the mediator felt that counseling was definitely in order. Twisting things to fit your agenda does no one any good...nor does it advance your agenda. It just makes you look foolish.
What Judge? This was not a Judicial hearing.
This was a settlement conference with a Friend of the Court representative known as a “Family Counselor”. At no time did she suggest Parental Alienation or anything even resembling such.
I filed the motion requesting court-ordered family counseling. This was what I wanted. So of course I am going to attend the counseling with my child.
Again, this was not a Judicial hearing.

Clearly you have some personal experience with Parental Alienation and I am very sorry for you if you have been a victim of Parental Alienation in your own life, however, your personal experiences are not congruent with my family’s circumstances and actually make no sense in the context of this thread.

Oh boy, I am sorry I missed this thread. I'm in Mi, matter of fact, I am one county over. I have spent 10 years in and out of various court rooms in 6 different county's.
"Family Counselor", that's garbage, they are not family counselors, they have no background in family counseling, there FOC workers, that's it, end of story. You actually can bypass FOC by filing your motions directly with the circuit court instead of going through FOC. I also want to clear up that this is not a mediator either.
When you have a hearing with FOC it is no different then having a hearing with a Ref. Both can only make recommendations, they do not make orders, only Judges make orders. You have a right to object to either FOC or a Ref's recommendation. County's vary on how that objection occurs. Been a bit since I have been in Oakland so I will have to look it up and see how they do it. But to give you an idea, you have a hearing with FOC, they come up with some recommendation and they will try and get you both to sign off on it, did this occur, did you both sign off on what the FOC's recommendation was?
If you do not sign off on it, then the FOC worker writes up that recommendation and it is mailed out to both parties and they have x amount of days to object(x amount varies by county). Did you ever get this recommendation in the mail? If so has the time frame expired for your objection(should be somewhere on the paper of how to object and how long you have)?
If you sign off on the recommendation, it gets sent to the Judge and they sign off and make it an order. If you don't sign off and it is mailed to you and neither party objects within the objection time frame, then it get sents to the Judge and they sign off and make it an order. Now there could be one exception to this, did dad have a lawyer with him? If not then that exception does not matter.
I can't give you further information without knowing if this has been signed by a Judge yet or if your time for an objection is up.
Your mistake was not understanding how courts in Mi go, not understanding FOC workers, Refs and your rights. FOC's job is to get you to sign that recommendation while there, they don't give a crap and don't listen to half of what you say and they most often don't even look at evidence you have. Their job is to get you to sign that recommendation. Same with the Ref, although from time to time you will actually run into 1 or 2 who actually do care and take the time to hear the case.
Posting on a website such as this offers you a chance for some great advice, however when you don't understand your own courts, you won't always get the advice you need. Questions are answered as they come and they are answered in general, unless ones know that your state is a bit different. You didn't do a good job of explaining all of this and explaining FOC and Refs and their functions and what options you have. Mi is different then most states because of FOC and Refs, unless you get someone who actually knows Mi courts well, or you explain it to them right, your not going to get good advice.
You really need to do a crash course on Mi courts, each sections function, what they can and can't do, what your rights are. You also need to do a crash course on Oakland county circuit court, learn the same as I said for Mi courts. Each county is a bit different with some of their own rules. A good starting place is with your FOC handbook, do you have one of those? Offhand I don't believe Oakland has it online, I will check for you. If they do not, you can get one by calling FOC(they will mail it)or by going to FOC and picking one up. This handbook explains a lot of things, and how things are done in that court and through FOC, it also explains your rights.
