    Making Fraudulent Returns to Your Own Employer
    My question involves criminal law for the state of: Texas

    Allegedly my boyfriend spoke to loss prevention one day because his new manager did inventory and found 25,000 dollars worth of parts missing. Since he is second in command they questioned him first. He was grilled for so long that he confessed just to get out of there already. signed a paper but was not arrested because the signature wasn't enough. He is not guilty of stealing so he was fired but not arrested. Now the cop calls him saying he is being charged for fraudulent returns of 2,500 dollars. What is the charged considered as? Theft? If he has a class c misdemeanor for theft already and he is convicted how much time is he looking at? What do you recommend we do?

    it could be a couple different actual charges from fraud or conversion are the first couple that come to mind



    and if you think that signature on a confession isn't enough to prosecute; guess again. I have seen it done and for a much smaller amount.

    in fact, just don't speak to anybody without a lawyer present or with the lawyers permission. Anybody he tells anything to is a possible witness against him.

    Ok another thing is he didn't keep money or products when doing these returns. He has no clue what returns they are talking about. Could it be like maybe someone returned something and it didn't fall under the return policy and he still returned it?

    I have no idea what the basis of the charge is and it would be worthless to try to speculate

    FYI, when j/k says get a lawyer and don't talk to anyone but that lawyer, it means your bf should not talk to you, either. You CAN be called as a witness against him and anything said to the lawyer in your presence is NOT privileged.
