Florida Criminal Mischief
My question involves criminal law for the state of: Florida
I am a renter. A man was paid to vandalize my ATT fiber optic wires ( my cable and internet) and to disable my air conditioner. ( He let the freon out and not sure what else but the estimate repairs is for a totally new unit) (this is the 3rd time the a/c was vandalized but we are unsure who did it the first two times, but it was done in retaliation to our property manager losing an eviction case. My daughter was a witness to the man coming out of the electrical room, he is a frequently used handy man for the property manager. I witnessed the man coming around the front of the building, saw the property manager with the driver who brought the man standing by his truck, and I witnessed after passing the man that he then went and talked to the property manager and the driver. All three then went briefly into my property managers unit and while I was reporting the crime, they left and I gave the plate number of the vehicle. The police came and took a report, would not take fingerprints. I and my daughter gave a description of the man . We were told there would be a photo line up later that day or the next. For two weeks I tried calling the officer, finally going to the station to see what could be done. Yesterday they came to do the photo line up with my daughter. The police report lists the drivers name and information. My daughter was 95% sure it was the man she saw and I ID'd him 100% but they said only her ID is admissable and where she is only 95% sure they can not do anything.
I want to press charges, is there anything I can do when the police will not do an investigation? :confused:

You can't force the state to prosecute. YOU are not the injured party here, the state is.
You should keep all your rental impropriety allegations in the same thread. We don't care to be duped over this stuff.

I have to say flyingron for a Senior member of this forum you seem to be a bit of a jerk when responding to people. How exactly are you being duped by me? I am coming on a law forum site requesting answers to legal questions. I posted here because I wanted to know about my rights as a citizen, when a crime was committed against me. I did not ask this question anywhere else on this forum. Where it loosely pertains to my other thread because the things are being done by the same person, one was a legal question about Power of Attorneys so I posted it under POA's , and this has nothing to do with the POA I asked about. The person did not use their POA to vandalize the a/c and cut ATT wires.
How am I not the injured party? and the state is??? The state doesn't live in my apartment nor do they pay my ATT bill . My wires were cut making a service I pay for not able to reach me due to someone tampering with them. My central A/C which was tampered with is not owned or used as part of a rental by the state , but me. The crime is against me and the homeowner which is not the person who did the actions. How is the state the injured party?
I do know I can go fill out paperwork at the state attorneys office and bring the police report and ask them to take it, so I am not sure why you are telling me I can't force them to prosecute I didn't say I wanted to force them to, I was wanting to know what my next step should be.

Because as I stated. You can complain to the States Attorney, the Governor or Obama for all it matters, you can NOT force the state to prosecute. You have to understand. A criminal prosecution is NOT ABOUT YOU and your alleged problems. It is the STATE OF FLORIDA that is the injured party in a criminal action. If they do not see a cause of action, that is all there is to it.
It doesn't matter how many threads you start on the subject, or how many illusory straws you are trying to grasp at, your issues with your landlord are not going to change.
