    Can You Lose Custody for Marrying a Sex Offender
    My question involves a child custody case from the State of: Illinois
    My ex husband and I have been divorced for 7yrs while we were married we had a child. In our divorce i won sole custody of our daughter due to his physical. a men tal abuse towards m. For the past 5 years I've been married to a man when at the age of 13 he grabbed a 37 yr woman's breast. He done his juvy time n still has to reg as a sex offender for being a day late on registering. My husband and ex husband met,before my husband went to prison(not on sex charges). My ex husband has tried to get me to leave my husband but since i refuse he is trying to use my husbands sex charge that is sealed against me to take my daughter away from me. What should i do legally to help me and my daughter?

    Yes i have. He sex offender charge he was open and honest with me about and showed me the paperwork.

    Which my ex knew about it as well

    Honestly? If I were your husband I'd high tail it into court and put them on notice that you are exposing your child to a sex offender who likes to beat on police officers. IF the court records were actually available to the public, you'd probably find that there was more to the sex charge than a 13 year old who took a 1 second feel at a grown woman's breast. Courts are WAY too lenient on children to lock a child up for that and then force him to register long term. How old is your husband now and how long is he required to register? How long ago was the other offense?

    What else is in his background that would give pause?
    Honestly, your ex meeting your husband doesn't mean anything. If my ex wife is bringing these types of folks around my child, I'd want to know what was going on too and I'm only going to figure that out by meeting them so I can dig up information.

    I have looked at my husband's record for that in fact I've talked to a lawyer to get it off his record . And as far as the battery charge the peace officers brother was the states attorney so he took a plea deal just so he wouldn't give him the max. My ex husband's past is not great either, i divorced him on grounds of physical and mental abuse. His now ex wife divorced him on grounds of physical and mental abuse,and his ex girlfriend had charges on him for it as well. As of now i make my daughter go with him as ordered in the divorce,but he makes fun of her just cause she is a girl and not the little boy he wanted.

    Like I said, YOU certainly know how to pick them. Both of the men you've chosen to expose your child to are criminals. Your ex husband's record or lack thereof won't be at issue and a judge has heard "he only took a plea because...." so many times he'll be able to complete the sentence for you. If your husband is a sex offender, is he even allowed around children?

    Yes he is dcfs even cleared him to be around his nieces and nephews went it was brought up before we married. I was asking for legal advice and opinions not to be bashed. I believe everybody deserves a second chance. I don't down grade my ex for his past nor my husband for his past. But I'm not turning my daughter over to him witout a fight. she has been in my care for 7yrs and I'm not giving up on her,my kids are everything to me.
