    What to Do if Your Ex- is Dating a Sex Offender
    My question involves child abuse or neglect in the State of: WASHINGTON STATE

    My ex wife has sole legal and physical custody. My children live 3 hours away I generally only ee them in the summer. They have been told horrible things about me and it has made it hard to have a relationship with them especially the 11 year old. My wife has given me bogus addresses before and moved them several times. She dated a man that went to jail for communication with a minor for immoral purposes. I never knew about it til a year later when I did a court search. My ex told me she cut all ties, he never hurt the girls etc... I suspected something was up but when I'd ask my ex why my 11 year old seems slow, wets her pants still, she would just come and get them and take them away. I found out my EX is indeed still seeing the level 2 sex offender, and also found a picture on facebook that proves my kids have been in his company. Can I get a restraining order against him or a no contact order for my minor children?

    Okay - are you absolutely positively 100% certain that he is a level 2 and his conviction did involve minors?

    But this is the relevant part:

    Quote:

    e) There is a rebuttable presumption that a parent who resides with a person who, as an adult, has been convicted, or as a juvenile has been adjudicated, of the sex offenses listed in (e)(i) through (ix) of this subsection places a child at risk of abuse or harm when that parent exercises visitation in the presence of the convicted or adjudicated person. Unless the parent rebuts the presumption, the court shall restrain the parent from contact with the parent's child except for contact that occurs outside of the convicted or adjudicated person's presence
    Obviously that's not the whole thing - you'll need to read that - but it is important.

    If I were you, I'd be filing a motion first thing Monday morning. Which county has jurisdiction? (I can try to find forms for you - I'm also in WA)

    I tried to address this in the past they live in Yakima County, I live in Snohomish, he supposedly lives in Grant County. Yes I am sure he is Level 2. The family court seemed very confused and told me I had to file modification in their (kids) county. I am no prize I realize, I pay child support but don't have the means to get over the mountain.

    Also the original order is out of Maricopa county in AZ where neither of us live. My girls said they they think their friend lied about the whole incident. He went to jail for 2 years I think he had a similar conviction 20 year prior it was an 8 or 9 year old girl.
