Searched After a Traffic Stop
My question involves police conduct in the State of: Georgia
Stopped by police for speeding; questioned by police for unrelated topic; searched by police; then vehicle searched and I'm once again searched by same officer; all this transpires before officer even runs my drivers licenses and insurance; no speeding ticket given; Where or what is the probable cause???; What's this? is it even legal??? What are my RIGHTS??? ALL THIS FOR A TRAFFIC STOP!!!! I FEEL VIOLATED!!! I FEEL HILMILIATED!!!
Re: Search After a Traffic Stop
Um, you have given no details of the situation so you nobody can really give you much of an answer, especially given that you are asking about probable cause.
Cops usually don't frisk people for no reason. Even less often is a an actual search for no reason.
so, no speeding ticket given. Were there any tickets issued>? If so, for what?
were you arrested or charged with a crime? If so, what was the crime?
Re: Search After a Traffic Stop
Did you give consent to search? Was there "resasonable suspicion" that you were committing a crime?
If you answered "yes" to either, then the search was legal.

You've covered this territory in several other posts.

Please stop.
Consult an attorney if you think there is something you want to do about it.
Re: Searched After a Traffic Stop
It sounds as if you were stopped as part of their drug interdiction program. You must have fit a special profile. Go onto youtube, there are many video's there explaining what it is and what they are doing. You must have given consent for them to search your vehicle, or in the very least, you didn't say no when asked. Officers usually use your lack of knowledge of the law to do searches that are questionable at best and may even be unconstitutional. Never consent to a search of your person or your vehicle. They may still search them, but then your attorney could have a reason to have whatever they may find, dismissed in court. Standing on your Constitutional Rights does not give a Law Enforcement Officer probable cause to proceed. He needs a legal reason to search, unless you don't object to it when he asks. Here is a video for you to watch. http://youtu.be/6wXkI4t7nuc

As a note, "reasonable suspicion" is sufficient for a detention, but not sufficient to justify a search of a vehicle. Consent, of course, would be.
