Held in Contempt for Not Paying Support, with Disability Claim Pending
My question involves child support in the State of: Connecticut
Ive been pending disability for the past year. Ive managed to pay child support by draining my savings. Im currently out of money and have awhile before a hearing in regards to my disability. I recieved notice my case was handed over to support enforcement. Im about 45-60 days over due. Will I be going to jail despite the fact its beyond my control? If so how long? And will I see my kids? Im guessing not much I can do so any help is greatly appreciated.
Re: Pending Disability Held in Contempt
If a contempt motion is brought before the court it is up to the judge to decide that.

Have you petitioned the court for a downward modification? If not, you have nothing to lose in doing so.
As a very general rule, if you can prove that you've applied for disability the courts tend to be a little more lax when considering contempt motions.
Mom cannot withhold court-ordered visitation due to child support arrears.
Also if you're approved for SSDI it can be garnished; if you only qualify for SSI it cannot be garnished.
