Hit by a Driver Who Was Changing Lanes
My question involves a traffic accident in the State of: California
hey there guys!
i was in a car accident recently where I was driving and the car to the left of me changed lanes into mine and hit me after I honked and tried to avoid him.
After I got out, he yelled at me and claimed that I hit him. The cops came and the other guy kept on screaming it. After the CHP officer took his information, he went over and took my side of the story as well.
I called my insurance and gave them the police report information. How long does it take for them to receive the police report information? And since we have conflicting stories, how valid is it?
Also, do car insurance companies look at the damage when they assess who is at fault? What is the process?

Insurance companies have their own policies for evaluating fault and it may well include an analysis of damage. Also, the insurance company is under no obligation to heed the findings of any police report and they can render their own decision.
The CHP should have the report completed within 10 days per policy and state law. The insurance company can ask for the report at any time. Often, their request will be in before the report is complete.
