    How to Get Custody of Children Placed With You by CPS
    My question involves guardianship in the State of: Texas

    Two boys, ages 9 and 12 years old
    My husbands cousins children
    The children been with us for 4 months this time, the youngest was places with us at the age of 2 for a year
    This is the parents 5th or 6th case with CPS because of drug abuse (meth)
    Father has started using again, mother had negative drug test last month
    The mother is completing services AGAIN, physiological evaluation came back deceptive for mom, dad has issues with sexual aggression and abuse
    Will there ever be a point in which CPS will take away the parents right?
    The mother has admitted to feeling homicidal towards the oldest child at one point, to CPS
    We are not sure about any kind of physical child abuse but think that something may come out when the boys start counseling in the next 2 weeks
    We feel in limbo and just want to give these children hope for the future. Is there a fighting chance that we could get custody of them?

    Yes, there is the possibility that both parents will have their rights terminated be it voluntarily or not.

    This is a very sad situation and though you're wanting to do the right thing (and yes, this IS the right thing to do in my opinion) you'll generally have to go through some hoops if you're to get custody.

    Get thee to an attorney IMMEDIATELY. The main thing against you is unfortunately a huge issue - that being that CPS haven't yet seen fit to act.

    Don't raise your hopes, but be prepared for a fight.

    Talk to the case worker. Their goal is usually reunification so unless they plan on termination of rights, they are not going to proactively assist. Ask if hypothetically were you to pursue custody, would they oppose your actions.
