Required to Start Probation Over After Failing to Report
My question involves criminal law for the state of: Mississippi
I feel like my probation period is too long. I caught a charge in 2008 for false pretense. I was placed on probation in 2009. I was sentenced to 3 yrs probation. I violated that probation by not reporting. when i was arrested for that, I was sent to restitution to pay off what was owed. when i got out i was told i would only have to finish what time was left on probation which was 1 yr and 299 days. But i was just informed that i have to do the whole 3 yrs over. Why? Who can I talk to about my probation being stopped or lessened. I only have the one charge and paid everything in full. Can anyone please tell me what i need to do or who I need to talk to. thank you
Re: Required to Start Probation Over After Failing to Report
Once you get voilte probation the state can make you start again from sq one. If someone was on probation for 5 years and 4 year and 6 months in they get arrested, the state can make them do that whole 5 years over again. (I'm not saying it fair but since it's the law you got deal with). Sometimes not showing up can be worse then getting arrested . Just follow all the probation rules,if you start behaving after awhile it show get to be less of a hassle. People I know after a certain amount time just had to call in.
Speak to a lawyer, after a certain amount of time I think you can file a motion or something to end your probation early. Like I said the state can legally make your do the whole 3 years all over again.

People get recommitted to probation all the time. You barely scratched the surface on your first go 'round. Your PO and the department will make sure that you do a substantial amount of probation time this time before they even entertain the idea of going along with early termination. Just go with it. Show a change of attitude and a willingness to comply and you'll be fine.
